Terms of Service — Road Trip

1. Use of the Service

Road Trip is a service that provides road trip games (including location-based games such as Landmark Lightning), AI-powered trip planning and place recommendations, gas expense tracking, weather forecasts, and related travel tools through its mobile application, website, and maps web experience. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. Use of the mobile application is also subject to the applicable app store terms (e.g., Apple App Store Terms of Service).

2. Driving Safety

Road Trip includes interactive games, quizzes, and other features that require your attention. These features are intended for use by passengers only and must never be used by the driver of a moving vehicle. You agree that you will not access, operate, or interact with any game or other attention-requiring feature of the Service while operating a motor vehicle or any other form of transportation.

You are solely responsible for complying with all applicable traffic and distracted-driving laws in your jurisdiction. HalfPeeled LLC disclaims all liability for any accidents, injuries, property damage, traffic violations, or other losses arising from use of the Service while driving or otherwise operating a vehicle.

3. Account & Device

Road Trip can be used without an account using a random device identifier generated locally on your device. Your data, including trips and fuel entries, is stored on our servers and associated with this device identifier. Optionally, you may sign in with Apple or create an account with your email address and a password to enable cross-device sync, trip history, and additional features. When you sign in, you are responsible for maintaining the security of your session and credentials.

You may create a profile with a display name, username, and profile photo. Your username and display name may be visible to other users you collaborate with on trips. Usernames must not contain hate speech, profanity, slurs, or otherwise offensive or inappropriate language. We reserve the right to modify or remove any username at any time, at our sole discretion, if we determine it violates these Terms or our content standards.

You may delete your account at any time from the app's settings, which will permanently remove your account data and associated content from our servers. We also reserve the right to delete accounts that violate these Terms.

4. Subscriptions & In-App Purchases

Road Trip offers a premium subscription ("Road Trip Pro") and other in-app purchases. Subscriptions are billed through the platform where you made the purchase (e.g., Apple App Store) and are subject to that platform's payment terms. Key details:

Payment is charged to your platform account (e.g., Apple ID) at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel subscriptions through your platform's subscription management settings.
Refund requests must be directed to the platform where you purchased (e.g., Apple), as we do not process payments directly.
Prices may change with advance notice. Continued use after a price change constitutes acceptance.

5. AI Features

Road Trip uses AI to power several features, including the AI Trip Planner (which generates suggested itineraries based on your inputs) and Recommended Places (which provides AI-curated monthly place collections). These suggestions are provided for informational and entertainment purposes only. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content, including business hours, directions, safety conditions, or point-of-interest details. You are responsible for independently verifying any information before relying on it for travel decisions.

AI-generated content (such as trip itineraries, stop suggestions, cost estimates, and place recommendations) is generated for your personal use. We do not claim ownership of AI-generated content provided to you. Your trip inputs and preferences may be sent to third-party AI providers (such as OpenAI and Google Gemini) for processing; these providers process data according to their respective privacy policies.

6. Accounts and User Content

When you create trips or set up a profile, you retain ownership of the content you provide (trip names, notes, stops, profile information, etc.). By using the Service, you grant us a limited license to store, display, and process your content solely to provide the Service to you. Your username and display name may be shown to collaborators on shared trips.

When you share a trip via a share link, you acknowledge that the trip details (stops, dates, and itinerary) become accessible to anyone with the link on the public web. You can revoke a share link at any time, which immediately removes public access. We are not responsible for content that was accessed or copied by others before revocation.

You agree not to submit content that is unlawful, infringing, or harmful to others.

7. User Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Reverse engineer, decompile, or disassemble any part of the Service
Attempt to gain unauthorized access to our servers or systems
Use automated systems, bots, or scripts to interact with the Service
Abuse rate limits or make excessive automated requests to our servers
Attempt to access other users' data or shared trips by brute-forcing tokens or identifiers
Choose a username that contains hate speech, profanity, slurs, or otherwise offensive content
Impersonate any person or entity through your username or profile
Redistribute, sublicense, or resell the Service or any content within it

8. Intellectual Property

All content in the Service — including but not limited to text, graphics, logos, game content, trivia questions, UI design, and software — is the property of HalfPeeled LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Third-Party Services

Road Trip integrates with third-party services including Apple Sign In, Apple MapKit, Apple WeatherKit, Apple iTunes API, Google AdMob, Google Places, RevenueCat, Google Analytics (Firebase), TomTom, Foursquare, OpenAI, Google Gemini, Pexels, Wikipedia, FRED, and Google Fonts. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content provided by third-party services.

10. Advertisements

Free-tier users may see advertisements served by Google AdMob. We are not responsible for the content of third-party advertisements. Road Trip Pro subscribers enjoy an ad-free experience.

11. Push Notifications

We may send you push notifications related to your trips, account activity, or service updates if you have opted in. You can manage notification preferences within the app's settings or disable notifications entirely through your device's settings.

12. Service Availability

Road Trip is provided on a commercially reasonable basis. We do not guarantee uninterrupted availability of the Service, API, or website. We may perform maintenance, updates, or changes that temporarily affect availability. Features may be added, modified, or removed at our discretion with reasonable notice for material changes.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

14. Limitation of Liability

To the maximum extent permitted by applicable law, HalfPeeled LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars (USD $50), whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless HalfPeeled LLC and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

16. Termination

We reserve the right to suspend, terminate, or delete your account and access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time by uninstalling the mobile application and/or ceasing use of the website. If you have an account, you may also delete it from the app's settings.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of New York.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the revised Terms within the Service with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
